I have noticed that Interseroh's position on the European market and it is a member of an international group, the most important of which is the realisation of EU citizens' interests. Decyzja nie była dla mnie trudna. I would like to say that I would like to develop, to learn from the best and to be a member of a group which has become the leader of the Polish recycling recycling industry. RAP obligations for end-of-life tires
Royal Decree 712/2025, of August 26, on end-of-life tires, establishes the obligation for all companies that produce, market, or distribute tires to manage or guarantee their collection, treatment, recycling, or management at the end of their useful life.
To this end, a series of obligations and collection criteria are established.
Obligations of producers
Royal Decree 712/2025, of August 26, on end-of-life tires, establishes the following obligations for tire manufacturers:
- Mandatory registration in the RPP - Tires Section, providing the required information and keeping the data on your activity as a producer up to date.
- Obligation to register with an SCRAP and declare annually information on tires placed on the market and ensure the transparency and traceability of contributions, collections, and management.
- Financing and organizing the collection and management of all end-of-life tires that have been placed on the market (regardless of the sales channel) throughout the country, ensuring their proper management in accordance with the waste hierarchy until they are completely recovered.
- Ensuring compliance with the minimum targets for preparation for reuse, recycling, and energy recovery established in the decree, and for producers of a certain size, this involves developing and implementing a waste prevention plan in your company.
What declarations am I required to make?
Every year, information must be compiled and submitted on the total number of replacement tires placed on the domestic market, indicating the total number of units and weight by category.
This declaration must be submitted before March 31 of the following year.
You are also required to provide information to the relevant public authorities on the development of the activity and the management of end-of-life tires, as well as to ensure traceability.

RAP obligations for tobacco filters and related products
If you are a manufacturer, importer, distributor, or retailer of plastic bags of any type or material through an online store, you are required, in accordance with Royal Decree 1093/2024 of October 22, which regulates the management of waste from tobacco products with filters and filters marketed for use with tobacco products containing plastic and which are single-use, to declare and pay for the management of waste from these filters generated in Spanish territory.
What declarations am I required to make?
Royal Decree 1093/2024, of October 22, regulating the management of waste from tobacco products with filters and filters sold on the market, establishes that these products must be declared annually through the corresponding PRO.
The provisional declaration of filters placed on the market must be submitted each year at the beginning of the financial year and include a realistic estimate of all products that will be marketed during that financial year, also specifying the materials they are made of and the percentage of plastic.
The deadline for submitting this declaration is March 31 for each financial year, except for companies that register after this date, for which the deadline is December 31 of each financial year.
Once the fiscal year has ended, the final declaration must be made, which is an adjustment to the provisional declaration, reflecting the actual quantities placed on the market in the previous fiscal year. The deadline for submitting this declaration is February 28 of each fiscal year.

RAP obligations for plastic bags
If you are a manufacturer, importer, distributor, or online retailer of plastic bags of any type or material, you are required, in accordance with Royal Decree 293/2018 of May 18, on reducing the consumption of plastic bags, to declare and pay for the management of all plastic bags placed on the market in Spain, as well as all waste generated by such bags.
Obligations of plastic bag manufacturers or distributors
The main obligations of plastic bag producers include the Register of the companies in
- the RPP-plastic bags section,
- registering with the corresponding SCRAPs for this product and paying the mandatory fees according to the number of bags and the materials they are made of, placed on the market annually.
In addition, in accordance with Article 40 of Law 7/2022, of April 8, on waste and contaminated soil for a circular economy, if you are a foreign company based outside Spain but marketing in Spanish territory, you are required to appoint an Authorized Representative to fulfill your obligations.
How can you comply with your obligation?
All companies that sell plastic bags must comply with their obligations. But how?
What annual declarations am I required to make?

EPR obligations for WEEE
Recycling of electrical and electronic equipment –
Whether you are a manufacturer, importer, or distributor of electrical or electronic equipment, or WEEE, or if you have an online store or sell through a third-party retailer, you are required to comply with Extended Producer Responsibility (EPR) in Spain in relation to WEEE products sold. This means that you are required to register your company with the RII-AEE and with a SCRAP appropriate for the type of products sold, as well as to declare all electrical and electronic equipment placed on Spanish territory.
The main objective of this regulation is that:
- The financial responsibility for the management of waste from marketed WEEE is financed, so that it only affects consumers of these products.
- A circular economy is promoted to encourage the reuse and repair of these products and a commitment to quality products.
- Environmental protection is promoted by reducing the environmental impact of the manufacture and marketing of these WEEE.
- The costs of waste treatment are covered, directly or indirectly, by the producer and passed on to the end consumer.

Obligations of WEEE producers
In accordance with Royal Decree 110/2015, of February 20, on waste electrical and electronic equipment, WEEE manufacturers or companies that sell them on the Spanish market must comply with the legal and environmental obligations arising from Extended Producer Responsibility.
Are you a manufacturer of electrical and electronic equipment? Do you resell equipment manufactured to order? Or do you import equipment from abroad into Spain? If so, you have the following obligations, among others:
- Organize and finance the collection of electrical and electronic waste and ensure its final treatment for recycling or destruction.
- Help achieve the minimum collection rate for waste electrical and electronic equipment and appliances by replacing old appliances.
- Promote the achievement of the minimum rate of recovery and preparation for reuse and recycling of waste from these electrical and electronic appliances.
- Carry out public education and awareness campaigns for the reuse, repair, or reuse of parts.

The list of categories of electrical and electronic equipment that fall within the scope of this Royal Decree can be found in Annex I & Annex II, and includes:
1. Large household appliances such as refrigerators and similar appliances, air conditioners, heat pumps, and other temperature exchange equipment
2. Small household appliances, max. 50 cm in length
3. IT and telecommunications equipment such as laptops and mobile phones
5. Lighting equipment such as fluorescent lamps, high-intensity discharge (HID) lamps, low-pressure sodium lamps, and light-emitting diodes (LEDs)
5. Lighting fixtures such as fluorescent, high intensity discharge (HID), low-pressure sodium, light emitting diode (LED) lamps
6. Electrical and electronic tools
7. Electronic leisure toys or sports equipment
8. Electrical or electronic healthcare products
9. Monitoring and control instruments

What declarations am I required to make?
Appliances and WEEE placed on the Spanish market must be declared quarterly to the PRO, and it is possible to correct previous declarations with the following quarterly declaration.
At the end of the year, a final declaration must be made, declaring all WEEE that has not been previously declared.
Payments to the selected SCRAP are also made on a quarterly basis
