Obligations of producers of batteries and accumulators
In accordance with Royal Decree 106/2008, of February 1, on batteries and accumulators and the environmental management of their waste, manufacturers of batteries, accumulators, or products containing them, or companies marketing them on the Spanish market, must comply with the legal and environmental obligations arising from Extended Producer Responsibility.
Are you a manufacturer of batteries, accumulators, or products that contain them?
Or do you import batteries from abroad into Spain? If so, you have the following obligations, among others:
- Organize and finance the collection of the waste generated and ensure its final treatment for recycling or destruction.
- Facilitate the selective collection of these batteries, depending on their size and end use, as well as the place of sale.
- Promote the achievement of the minimum recovery and preparation rate for reuse and recycling of these batteries.
- Carry out public education and awareness campaigns for their selective collection.

What declarations am I required to make?
Batteries, accumulators, and products containing them that are placed on the Spanish market must be declared quarterly to SCRAP, and it is possible to correct previous declarations with the following quarterly declaration.
At the end of the year, a final declaration must be made, declaring all WEEE that has not been previously declared.
Payments to the selected SCRAP are also made on a quarterly basis
